Rental Terms and Agreement
RENTAL SERVICE AGREEMENT PARTIES AND PURPOSE
This contract; The lessor of the "VILLA/SUMMER" (hereinafter referred to as the "TENANT") and the lessor of the "VILLA/SUMMER", Hayatim Tatil Emlak Turizm Ticaret Ltd. Sti. (hereinafter referred to as "Holiday Life") for the purpose of renting the "VILLA / HOLIDAY" for a certain period of time, the start and end dates of which are predetermined by the parties. The tenant and those accompanying him who make a reservation for any of our villas/cottages specified on the "www.holidaylifetour.com" website via our internet page or via telephone or e-mail are deemed to have accepted the following conditions. In case of breach of any of the conditions stated below, "Holiday Life" gives the right to unilaterally cancel the rental process, request the tenant to leave the villa/cottage, not refund the rent received, deposit and demand the entire unpaid rent.
RESERVATION AND PAYMENT
Pre-reservation can be made for our villas/cottages, which are marketed by us, via the reservation form on our website, via telephone or e-mail. Holiday Life determines the dates you want to rent and takes your necessary transportation and billing information from you and makes your rental. Holiday Life takes 35% of the total fee to be paid for the villa/cottage as a deposit after the rental process is made. If the deposit is paid within 1 (one) business day after the rental, the villa/cottage is reserved and held in your name. The deposit amount you have to pay and our bank account numbers will also be notified to you via e-mail, SMS or telephone. Holiday Life has the right to unilaterally terminate the contract within one (1) business day after the payment is received. Deposit can be paid by Wire Transfer, EFT and Credit Card on the site within 1 (one) business day. The rental confirmation of the Villa/cottage will be sent to you in writing within 1 business day at the latest after the deposit is received. In the rental, the total fee, the deposit received, the dates on which the villa was rented on your behalf and the time of day of the deposit you deposited are reported. If the deposit is not deposited within 1 business day, Holiday Life will be able to use its right to cancel the pre-reservation and get another reservation for the villa/cottage without informing the tenant. The remaining fee of the villa/cottage is taken in cash (cash) after the contract is signed and the villa/cottage is checked, and upon the delivery of the villa/cottage. Again, Holiday Life, due to the fact that the rented property is delivered to the tenant furnished, broken, broken, damaged, lost, lost, etc. Although there is a damage deposit of 500 TL / 8000 TL, this deposit is taken in cash (cash) at the delivery of the Villa / Summer House. ENTRANCE AND EXIT TIMES TO THE VILLA / HOLIDAY
The check-in time to the villa/summer apartment on the reservation start day is 16.00 at the earliest and 21.00 at the latest. Tenant; He cannot enter the villa/cottage outside of the specified hours, and if he arrives after the specified check-in time, he can enter the villa/cottage one day later at the beginning of Holiday Life's working hours (09:00). the tenant; In case of arrival before or after the specified time, problems arising from not being able to enter the villa/cottage, overnight accommodation, inability to find accommodation, etc. Holiday Life cannot be held responsible for any problems. The tenant has to find the place where he will spend the night and pay the accommodation fee himself. Holiday Life cannot be held responsible for such situations. At the end of the reservation, the departure time from the villa/cottage is 10:00 in the morning at the latest for all our regions. Problems, damages, grievances, etc. arising from the tenant's failure to vacate the villa/cottage at 10:00 in the morning or late evacuation. The customer is personally responsible for all negativities and Holiday Life is obliged to cover any financial losses that may arise from these negativities. We strongly remind you that travel plans are made according to these hours so that both parties do not suffer. In case of early departure, Holiday Life must be informed 24 hours in advance. In case the tenant leaves the villa/cottage without being able to control the villa/cottage due to congestion, the damage deposit will be sent to a bank account to be notified by the tenant. In case the tenant leaves the villa/cottage early on his/her own request, no refund will be made to the tenant for the accommodation fee.
VILLA/SUMMER CAPACITY
Guests are not accepted to our villas/cottages above the capacity specified on our website or the number of people specified when making the reservation. (Including children and infants). If the tenant wants to make a change in the number of people after the rental is finalized, Holiday Life will apply in writing and this change can be approved if Holiday Life deems it appropriate according to the capacity of the villa/cottage. Holiday Life may charge additional fees from the tenant. After entering the villa/cottage, no guests are accepted to the villa/cottage, except for the guests specified in the reservation list. In cases where it is determined to the contrary, Holiday Life has the right to request the guests to leave the villa/cottage, to cancel the reservation completely or to request the villa/cottage to be completely evacuated without waiting for the end of the rental period, to charge the entire fee and an extra fee. During the rental phase of the villa/cottage, action is taken in line with the declaration of the tenant, and the tenant accepts all responsibilities that may arise in this regard, that the information he/she has given is correct and complete.
VILLA / SUMMER CLEANING / MAINTENANCE AND EXTRA EXPENSES
Daily, weekly, monthly villa/cottage rental prices include entrance cleaning. Weekly cleaning and towels/sheets etc for stays of 2 (two) weeks. change is included in the price. Apart from this, all kinds of cleaning and towels / sheets etc. to be requested. exchange is subject to a fee. In addition to the total amount, the extra short stay fee may be included in the price for the stays that will be less than the minimum stay in our villas. This price may vary according to the villas, it is posted in the prices section on our website. Every morning, pool and garden maintenance is carried out, and if any technical problems occur from the villa during the rental period, it will be fixed by the landlord. The villa owner is responsible for all problems that may arise regarding the maintenance of the pool and garden. Holiday Life is only an intermediary institution in the rental process and is not responsible for any problems that may occur, it only helps to solve the problem. In order to carry out the periodic maintenance of the pool, garden and other fixtures of all villas/cottages, the personnel in charge must enter the garden or inside the villa/cottage. In order for these services to be carried out without interruption, the tenant must allow the personnel in charge to enter the villa/cottage when necessary. Unless otherwise stated on the villa/cottage detail page on our website, electricity, water, bottled gas, pool lighting, internet connection and air conditioning usage are included in the prices. Pool lighting, air conditioning and internet may not be available as standard in all our villas/cottages, so it is recommended that you carefully read the properties of the villa/cottage you are renting on our villa/cottage properties page.
PET/CIGARETTE
Unless otherwise stated, pets are not allowed in our villas/cottages. Smoking is not allowed in the closed areas of all of our villas/cottages.
PRICES
Villa/cottage rental prices stated on our website are daily, weekly, monthly. Deposit can be made to our bank accounts by money order, EFT or Credit Card payment system.
RENTAL / PAYMENT / CANCELLATION TERMS AND RETURNS
Even in cancellations made up to 30 days before your entry to the villa/cottage, from the moment you pay the prepayment amount of the villa/cottage rental fee deposited in our account (with EFT or Money Order or Credit Card, "one shot" or Cash or Mail Order ). prepayment will not be refunded. Because all of this payment was made as a prepayment to the owner of the villa/cottage. You have to pay the remaining amount to us at the time of entry to the villa/cottage. The tenant can cancel their trip before the trip begins. It is obligatory for the tenant to make the cancellation notice to Holiday Life in writing, and notifications not made in writing cannot be accepted. In case of cancellation, Holiday Life will collect certain percentages from the customer over the total costs of the services specified in the travel agreement in order to cover the precautions and expenses related to the travel. These amounts were determined as follows.
Cancellation conditions;
35% deposit collected by us for the A-Villa rental process .
If the B-Villa rental is up to 30 days before the entrance to the villa, 35% of the villa rental price must be paid.
If the C-Villa rental process is made 29 days before the entry date to the villa, 100% villa rental fee will be charged.
D- In case the rental process is canceled by Holiday Life for any reason. This notification will be made by us as soon as possible. At the same time, if there is another villa with the same features available for the same period in our portfolio, it will be recommended to our guest. In cases of force majeure (earthquake, flood, disaster, etc.), the entire payment will be returned to the guest.
If you do not come to the specified villa after the rental process you have made through E-Holiday Life, if you leave early, no refund will be made.
If there is a special cancellation policy for some Villas/Summers found in our F-Portfolio, it is definitely stated in the information section of the villa.
G- In the return transactions requested by you, the notifications made by e-mail or registered mail with return receipt will be taken as basis and will be considered valid from the moment they reach us.
H-In case the tenant fails to make the remaining payment after the deposit payment, Holiday Life reserves the right to rent the specified villa to other persons.
After receiving the K-Payment, Holiday Life has the right to terminate the contract unilaterally within one (1) business day. In these cases, the refund will be made to the customer's account or credit card within 1 (one) day. If, for any reason, the villa/apartment reservation is unilaterally canceled by Holiday Life, this situation will be notified to the customer as soon as possible. If there is an equivalent villa/apartment available on the same dates in our portfolio, it will be proposed to the customer. In cases where the customer does not approve and does not fall under the "force majeure" clause, the money received will be returned to the customer. Holiday Life is not responsible and cannot be held responsible for any damages that may arise from reservations canceled by Holiday Life. Flight ticket, bus ticket, rented car, boat, transfer service etc. also hotel and hostel accommodation fees etc. burning of all the details he has paid, the permissions he has taken from the private company or the state, etc. Holiday Life is not responsible for all details and cannot be held responsible. EXCEPTIONAL CASES
If the necessary documents are submitted to our company in cases such as war, threat of war, social turmoil, terrorist acts, natural disasters, health risks, epidemics (Covid-19, etc.) or death in the 1st degree immediate family of the reservation owner, which is completely beyond our control, the amount paid for the reservation The prepayment is taken to be used in a different reservation and the transaction is made by deducting the total amount of the new reservation. **The total amount of the new reservation to be made may vary depending on the selected facility or the dates of stay.
DAMAGE DEPOSIT
Depending on the characteristics of each villa/cottage, a different amount of damage deposit will be charged from the tenant. This amount of deposit will be written in the confirmation document sent to the tenant during the reservation process. The damage deposit will be collected from the tenant in cash on the day of entry to the villa/cottage, and in the control to be made before the tenant leaves the villa/cottage, the villa/cottage delivered intact and the fixtures of the villa/cottage are also damaged, missing, etc. If not, it will be refunded in cash. In case the tenant wishes to leave the villa/cottage earlier than specified in the contract or the villa/cottage exit control cannot be made due to the density, the deposit will be sent to an account number to be taken from the tenant. If the damage to the villa/cottage exceeds the deposit received, the tenant will be asked to pay for this damage, otherwise legal action will be taken.
SWIMMING POOLS
Swimming pool temperatures of our villas/cottages; it varies according to the weather and seasonal temperature, Holiday Life cannot be held responsible for the tenant who rents the villa/cottage not being able to use the pool due to the coldness of the pool. The tenant who will rent the villa/cottage can get information from the website of the General Directorate of State Meteorology or by calling the General Directorate of State Meteorology to learn the weather conditions on the date of renting the villa/cottage. Holiday Life cannot be held responsible for adverse weather conditions.
OUR RESPONSIBILITIES AND WARRANTY
Holiday Life is responsible for delivering the villa / cottage to the tenant on the specified date and time, clean and ready for use. At the entrance to the Villa / Summerhouse, if there is any broken, non-working item or malfunction, Holiday Life should be notified immediately by the tenant and these problems should be requested to be corrected. Holiday Life will notify this request to the villa/cottage owner or the relevant company and will ensure that this defect is rectified within 48 hours at the latest. Holiday Life is not responsible for troubleshooting, it helps to fix the problem. Holiday Life cannot be held responsible for failures that are not reported on time. Holiday Life is an intermediary between the owner of the villa/cottage and the tenant, and therefore the owner of the villa/cottage is responsible for eliminating any malfunctions that may occur in the villa/cottage. Apart from this, any accident, illness, injury, drowning in the pool, death, etc., which may occur and are under the responsibility of the tenants. Holiday Life cannot be held responsible for fire, theft and similar incidents and accidents that may occur in the villa/cottage. Apart from this, travel, shopping, food, beverage, entertainment, transportation, travel, guidance services, etc. that the tenant will receive from third parties / companies during the holiday, on their return to the villa / cottage. Holiday Life will not be responsible for any problems arising from any service such as After leaving the villa/cottage, the tenant cannot claim any right or reimbursement for a service that he could not receive due to a malfunction, problem or malfunction that Holiday Life did not report during his stay in the villa/cottage.
INVOICE- TAX
No villas or cottages published on the Holiday Life website do not belong to Holiday Life. The owners of each villa/cottage are different people, individuals, companies. Holiday Life is an intermediary for individuals, individuals, companies to rent their villas/cottages to the lessee. For this reason, Holiday Life only issues service invoices. In other words, it earns a certain service fee profit from the fee paid by the tenant and invoices this profit, and this profit may be different for each villa. Since the other remaining income is the income of the villa/cottage owner, it does not invoice the rest. Holiday Life does not issue invoices for the earnings of third parties, institutions, individuals, companies, is not responsible for this, cannot be held responsible.
RIGHT OF WITHDRAWAL
Pursuant to subparagraph (g) of Article 15 of the Distance Contracts Regulation, which was prepared on the basis of Articles 48 and 84 of the Consumer Protection Law No. 6502, accommodation, goods transport, car rental, food and beverage, which must be done on a certain date or period The consumer cannot exercise his right of withdrawal in contracts related to the supply of goods and the use of leisure time for entertainment or recreation.
TENANT'S RESPONSIBILITIES
The tenants are obliged to use the villa/cottage, pool, garden furniture, all electrical and electronic goods and other furniture in the villa/cottage delivered to them in good working condition. Tenants are obliged to leave all kitchen utensils delivered to them clean in the same way. In cases where the villa is left unreasonably dirty, Holiday Life will charge a cleaning fee from the damage deposit. In case of any damage to the villa / cottage, the tenants are obliged to inform Holiday Life. If the damage deposit has been taken, the cost of all kinds of damage to the villa/cottage during their stay and the cost of all kinds of goods lost by the tenants will be deducted from this deposit, and in case of damage exceeding the damage deposit, the tenant will be requested to pay in cash. In addition, the tenant and those accompanying him should take care to comply with the social and moral rules, not to make noise in a way that disturbs the environment, not to listen to loud music, and not to engage in criminal behavior that is prohibited by the laws of our country. For such reasons, Holiday Life has the right to request the tenant to vacate the villa/cottage before the reservation period expires, in case Holiday Life receives a complaint about the tenant and their accompanying persons. Holiday Life does not guarantee the invisibility of our tenants, who will stay in the villas specified on the web page and defined as conservative (villas whose pool is not visible from the outside), in villas that do not have a 100% sheltered statement. Tenants must ensure their own privacy and security measures to protect themselves from invisibility, theft and other criminal exposures. Holiday Life does not accept responsibility for such problems. Holiday Life cannot be held responsible for such problems. The tenant undertakes to empty the villa unconditionally at the end date and time of the rental period .
Force Majeure
In cases of force majeure, Holiday Life may terminate this contract unilaterally without any legal liability. War, threat of war, uprising, strikes, natural disasters, fires, terrorist activities, epidemics, technical problems that may occur in transportation in the region or in the country, Superstructure and infrastructure works carried out by municipalities or public institutions, which cannot be prevented Holiday Life, Prohibitions and events that are unpredictable and beyond our control will be considered within the scope of force majeure.
COMPLAINTS
The tenants will report their complaints to Holiday Life during their stay in the villa/cottage. The situation that is the subject of the complaint will be investigated by Holiday Life officials and necessary measures will be taken immediately. Holiday Life cannot be held responsible for the complaints that are not reported during the stay, which will be made after the stay and after leaving the villa/cottage.
SECURITY AND PRIVACY POLICY
Holiday Life will not disclose personal information to any company or third parties, except as defined in this Privacy Policy and Terms of Use. Holiday Life never sells the personal information of visitors, registered users and partners to third parties. Personal information; means all kinds of information to identify the user, such as name, surname, address, telephone number, e-mail address. Holiday Life will be able to use personal information within its own body to determine user profiles and to conduct statistical studies, and may share it with third parties only for the purpose of carrying out these studies. Holiday Life is committed to keeping personal information strictly private and confidential, to consider it a confidentiality obligation, to ensure and maintain confidentiality, to take the necessary measures and to take the necessary care to prevent all or any part of the confidential information from entering the public domain or unauthorized use or disclosure to a third party. commits to show Although Holiday Life has taken the necessary information security measures, Holiday Life will not be liable if confidential information is damaged or in the hands of third parties as a result of attacks on the "www.holidaylifetour.com" site and the system. OTHER IMPORTANT INFORMATION

2) Accidents etc. that may occur during transportation to the villa/cottage. Holiday Life cannot be held responsible for any negativity.
3) If different materials used in the construction of some villas (cedar wood, pine wood, some plastic products, all kinds of plants in the garden or inside the villa) disturb the tenant in terms of health, Holiday Life cannot be held responsible for this incident.
4) A private vehicle will be required for the tenants who will stay in all our Villas/Summer Houses. It is the tenant's own responsibility to reach the villa/cottage.
5) The tenant may obtain a taxi, transfer vehicle or rental vehicle from third parties. Holiday Life does not interfere with the transfer or taxi service that is rented or rented from third parties. These transactions are the tenant's own responsibility.
6) Holiday Life cannot be held responsible if the tenant who has rented a villa or a summer house is dissatisfied with the geographical location of the villa or cottage he has rented. Holiday Life has marked the location of the villa/cottage approximate on Google Map.
7) Holiday Life cannot be held responsible for the damage to the private or rented vehicle of the tenant during the transportation to the villa/cottage.
8) If the vehicle (motor, automobile, etc.) of the tenant who has rented the villa/cottage is close to the ground, the vehicle's engine power is weak, the tenant's; automobile, engine etc. The tenant is responsible for any problems that may arise due to the problems in using it and the inability to reach the villa/cottage accordingly. Holiday Life cannot be held responsible for these or similar problems.
9) The "distance table" specified on the "www.holidaylifetour.com" detail page about the villa/cottage is written approximately. Distances are not precisely specified. There may be some mistakes. The tenant who rents the villa/cottage agrees to take this into account.
10) The “airport” specified in the distance table on the “www.holidaylifetour.com” detail page about the villa/cottage is the closest airport to the villa/cottage. This; Dalaman, Bodrum or Antalya etc. It could be the airport. You should ask the Holiday Life official which airport is closer. Otherwise, Holiday Life cannot be held responsible for the problems caused by purchasing a flight ticket to the wrong or far airport.
11) The distances specified in the distance table on the "www.holidaylifetour.com" detail page about the villa/cottage are written considering the nearest restaurant, the closest beach, the nearest settlement, the nearest public transport route and the nearest airport. Holiday Life does not accept responsibility if the specified restaurant or market is closed.
12) Holiday Life cannot be held responsible for accidents such as drowning and falling that may occur in the pool in the villa/cottage.
13) Food, beverage, any food product etc. in our villas/cottages. not available. The supply of these products is the customer's own responsibility. Islamic Holiday Villas cannot be held responsible for such situations.
14) Most of the villas have a hot water tank of approximately 160 liters heated by solar energy. The customer is personally responsible for the problems caused by the lack of hot water due to excessive consumption of hot water outside of fair use. Holiday Life cannot be held responsible for problems arising from this situation.
15) Holiday Life cannot be held responsible for situations such as no mobile phone signal being received, low reception or no internet connection from the mobile phone in villas/cottages or on the road. You can call your GSM operator and get detailed information about the GSM signal status in the area you are going to.
16) All accidents and incidents caused by the tenant in the villa/cottage, fire, electricity leakage, tube leakage and death and accidents as a result, telephone and internet cut-off caused by the internet provider (Türk Telekom, etc.), power cut caused by the Electricity Company, Water Company. Holiday Life cannot be held responsible for water cuts caused by

18) The Villa/cottage we have stated on our website is exactly the same, it is not as it appears on the site, it looks better on the site, it is bigger or smaller on the site, etc. Such notifications are never acceptable and Holiday Life cannot be held responsible for them.
19) Holiday Life cannot be held responsible for any negativity that may arise from positive or negative natural events/conditions and positive or negative weather/conditions.
20) Tenant; bee, scorpion, insect, snake bite, cat, dog bite and etc. Holiday Life cannot be held responsible for events.
21) The customer who wants to prefer conservative villas, which are called villas whose pool is not visible from the outside, can be found on the detail page of the villa; “this villa is suitable for conservative families”, “the pool is not visible from the outside”, “women wearing hijab may prefer” etc. If there are no phrases, that villa is not a conservative villa. Holiday Life is not responsible for the accusation of Holiday Life by renting the villa without such phrases. We recommend that the customer who will rent the villa read all the details carefully.
22) The contract is subject to Turkish Law. Kaş (Antalya) Courts and Execution Offices will be authorized in disputes arising from the contract.
23) The parties shall not transfer or assign any benefit arising from the Contract and any part of the Contract or any interest in the Contract, neither on a pre-existing condition nor without the prior written consent of the other party, and will not take any action in this regard.
24) The invalidity of any provision of the Agreement shall not affect the invalidity of the remaining provisions. Invalid provisions will be changed or renewed to ensure the purpose and continuation of the Agreement.
25) Stamp tax arising from the contract will be borne by the TENANT.
26) The TENANT, the information and documents given under the Contract are complete and correct, the IP address belongs to him, he accepts all responsibility arising or to arise due to this in advance, he can be terminated by Holiday Life immediately in case of giving false or false information, in this way. In case of termination, it accepts, declares and undertakes in advance that it cannot demand the return, cancellation or amendment of its contractual obligations.
27) The TENANT cannot use someone else's IP address, e-mail address, user name and other information while accessing the Website, and cannot access or use the confidential information of other users without permission. Otherwise, all legal and penal responsibility belongs to him.
